Benjamin Phillips was born on 10 September 1760 (Phillips Bible). He married Ruth Boggs circa 1778 in Accomack Co., VA. Ruth was born in Accomack Co., VA, on 22 October 1759 (Phillips Bible). Ruth was the daughter of Francis Boggs and Ruth Parker. NOTE: See HOUSEHOLD 12. She witnessed the will of Benjamin Phillips, her father-in-law on 16 January 1795 in Accomack Co., VA. It was probated (Nottingham). NOTE: See HOUSEHOLD 3.
The Prosession of 1795, as it originally reads: "Lines between Michael Parker & Benjamin Phillips. Lines between William Smith & Benjamin Phillips" (Walczyk). He was a Witness.
In Francis Boggs' will on 9 September 1811 in Accomack Co., VA, Ruth was named as an heir. It was probated 30 May 1813. An abstract of his Will reads:
Wife Ruth Boggs & son Francis Extr. To wife Ruth Boggs my land whereon I now live with my marsh which I hold in partnership with my brother John Boggs & all my personal estate & at her death to son Francis Boggs. To son Francis..... If Daughter Comfort should be a widow, then she should have a home with my son Francis. To daughter Comfort my Negro boy George provided she does not move him out of Accomack County & at her death to daughters Ruth & Esther, but if she tries to move him out of Accomack County, then he is to go immediately to Ruth & Esther. To grandson Joseph Boggs Taylor... To daughter Ruth Phillips ... To daughter Esther Taylor the use of my Negro woman Nell, girl Hannah & my man Isaac, but if she should attempt to sell them, then to my other children. Remainder to my daughters Comfort Smith, Ruth Phillips & Ester Taylor. Witt: John Finney & William H. Custis. Probate: Partly proved by William H. Custis & fully proved by John Finney with George Scarburgh & John Arlington securities.
In Benjamin Phillips' will on 16 January 1795 in Accomack Co., VA, Benjamin was named by his father as an heir. It was probated (Nottingham). An abstract of his will reads:
PHILLIPS, BENJAMIN, SR. - 16 Jan. 1795 - 29 Sept. 1795 - To wife Susanna Phillips whole estate for life & then to my son Jonathan Phillips, & should William Phillips Topping live to come to lawful age, my son Jonathan Phillips to pay him the sum of 10£. Witt: John R. Parker, Ruth Parker. Codicil: To son Benjamin Phillips all my land where I now live at his mother's death. Same witnesses. In order of probate: Jonathan Phillips qualified.
Benjamin was listed on the personal property Tax List for 1787 (Yantis-Schreiner 99). The record reads: "Benjamin Phillips Jr. charged with the tax, 1 male over 16 and under 21, 2 horses, mares or colts, 4 cattle."
The Procession of 1795, as it originally reads: "Eleventh District Decr 29th 1795 - Lines between Michael Parker & Benjamin Phillips. Lines between William Smith & Benjamin Phillips...." (Walczyk).
In 1800 Benjamin had seven lining children, two of whom were nearly grown. (Roundtree: 4).
In 1803 bENJAMIN Phillips bought the old cooper Plantation at the head waters of Harris Creek in Elizabeth City Co., VA [Hampton] (4)
Benjamin Phillips had Ruth Boggs the following children:
1. i. Elijah Phillips was born 17 May 1781(Phillips Bible). Elijah died in 1781 (Roundtree: 5)
2. ii. Charles Phillips was born 22 August 1783 (Phillips Bible). Charles died in 1821 (5)
3. iii. George Kerr Phillips was born 18 October 1785 (Phillips Bible). He married Sarah Croswell circa 1811 (Phillips Bible). Sarah was born 19 December 1789. She was the daughter of William and Patience Croswell (Phillips Bible). She died on 21 January 1882 (Phillips Bible). George died on 24 September 1856 (Phillips Bible)
4. iv. William Phillips was born in 1787 (Roundtree: 5). He died in infancy (5)
5. v. Elijah Phillips was born in 1790 (Roundtree: 5). He died in 1848 (5).
6. vi. James Phillips was born in 1792 in Accomack Co., (5) VA. He died in 1861 in Hampton VA. (5).
7. vii. Susannah Phillips was born in 1794 in Accomack Co., VA (5).
8. viii. Elizabeth Phillips was born in 1796 in Accomack Co., VA (5).
9. ix. Francis Boggs Phillips was born in 1798 in Accomack Co. VA (5).
10. x. Nancy Phillips was born in 1802 in Accomack Co., VA (5).
11. xi. Joseph Boggs Phillips was born in 1804 in Hampton VA (5). He died in 1851 in Hampton VA (5). He and Benjamin were twins (5).
12. xii. Benjamin Phillips was born in 1804 in Hampton VA (5). he died in 1890 in Hampton VA (5). He and Joseph were twins (5).
